Статья посвящена исследованию наиболее распространенных ситуаций в рамках отношений банков с иными юридическими лицами, влекущих за собой такие последствия, как необходимость применения одной из сторон договора банковского счета норм гражданско-правовой ответственности к контрагенту. Особое внимание уделено причинам возникновения необходимости применения различного рода мер ответственности по договору банковского счета. Предложены возможные способы минимизации рисков несения ответственности для сторон рассматриваемого договора.
The article is dedicated to the research of most common situations in the relations of banks with other legal entities that entail such consequences as the must for one of the parties to the bank account agreement apply civil liability norms to the counter party. Special attention is paid to the causes of the necessity for taking various kinds of liability measures under the contract of banking account. The possible ways of minimizing incurring liability risks for the parties to the treaty under consideration are proposed.
